GENERAL CONDITIONS
- TO PICK UP THE SCOOTER, A VALID DRIVER'S LICENSE AND A CREDIT CARD ARE REQUIRED.
- The minimum age for the driver and reservation holder is 18 years old, and they must possess a driver's license, at least for mopeds with 50cc engines and a car license with a minimum of 3 years' experience for scooters with 125cc engines.
- Any missing fuel at the time of scooter return will be charged with a surcharge of 1 euro per liter for refueling expenses.
- The franchise is €300 + VAT for 50cc scooters and €500 + VAT for 125cc scooters. Removing the franchise costs €10/day for 50cc scooters and €15/day for 125cc models, payable at the rental office upon collecting the scooter.
- Helmets: 2 helmets will be provided for each scooter and included in the price.
- In case of breakdown, assistance will be provided by the rental company.
- Returning the scooter after 21:00 will incur a supplement of €20, payable at the rental office.
- The lessee receives the vehicle in perfect working condition, which they confirm upon taking possession of it, acknowledging being informed of the type of fuel required for the vehicle, and committing to return the vehicle in the same condition as received.
- The lessee agrees to pay all fines imposed for non-compliance with traffic rules and to notify the lessor at the time of settlement.
- The lessee will assume both civil and criminal responsibility that may arise from the use of the rented vehicle and, under no circumstances, engage in the transport of illegal goods.
- Any claim regarding the rental service shall be made with the company Migjorn Rent Motos, and Baleària will not directly handle claims related to this service.
RENTAL CONDITIONS

Regarding what is established in the previous article, the lessee is insured for civil liability to third parties through an insurance policy contracted by the lessor with an insurance company, and for personal injury according to the measures and conditions established in the Mandatory Insurance Regulation.

Service hours are from 9:00 to 21:00, and after this time, the lessor is not obligated to take responsibility for the vehicle until 9:00 the next day, and they may charge the corresponding fee for this concept. However, in the event of a breakdown in the vehicle that prevents its proper return to the lessor within the mentioned schedule, the lessee acknowledges being informed of the permanent phone number during business hours for notifications. Therefore, the inability to communicate with the lessor about the breakdown or the impossibility of returning the vehicle will not exempt the lessee from liability.

The lessee agrees to carry the document issued by this company with them to present if requested by the Authority or the company's personnel.

The lessor reserves the right not to rent the vehicles if they deem it appropriate. Likewise, the lessor may withdraw the rented vehicle if the lessee misuses it or if the vehicle is driven under the influence of alcohol, drugs, fatigue, or illness.

Under no circumstances is subleasing or driving the rented vehicle allowed by individuals other than the contracting client unless expressly authorized by the lessor.

Any damages caused to the rented vehicle due to an accident or any other cause, including damages resulting from fire and theft, will be the responsibility of the lessee. This is with the exception that an additional fee for the release of liability for material damages and theft has been agreed upon with the lessor, which, in any case, includes a deductible of up to €300 for 50cc scooters and €500 for 125cc scooters.

The lessor declares to have taken the necessary precautions to avoid mechanical failures of the rented vehicle, and the lessee declares to have verified the good condition of the vehicle when taking possession of it and to have been informed of the type of fuel required. In the event of mechanical failures or failures due to the use of incorrect fuel, the lessor assumes no responsibility for any direct or indirect damages that may be caused to the lessee as a result of such failures or breakdowns. Likewise, any breakdowns resulting from the use of incorrect fuel or driving the vehicle with flat or damaged tires will be the responsibility of the lessee due to negligent use of the vehicle.

Vehicle theft will result in the loss of any sums paid as profit or payment, regardless of their nature.

The lessee declares to possess the corresponding driver's license for the rented vehicle.

The VAT must be paid by the client.

For any disputes that may arise in connection with this contract, the parties expressly submit to the judicial jurisdiction that is legally applicable.

The lessee acknowledges being informed of the mandatory use of helmets for driving all rented vehicles. The helmet may be provided by the lessor, and the lessee is obliged to return it in the same perfect condition as received. The lessee will be responsible for any loss or theft of the helmet and must pay the lessor the sum of €40. The lessee is also responsible for any damages, fines, and penalties imposed for not wearing a helmet while driving.
